Understanding I-751 Affidavits: Supporting Your Petition to Remove Conditions on Residence

When applying to remove the conditions on your Green Card through Form I-751, providing strong evidence of a genuine marriage is essential. While joint financial documents, leases, and birth certificates are primary forms of proof, statements from friends and family, known as affidavits, can offer valuable support. These affidavits, also called letters of support, can help fill gaps in your documentation and offer a personal perspective on your relationship.

USCIS, the United States Citizenship and Immigration Services, considers these affidavits as optional supporting evidence. However, they can significantly strengthen your petition, especially if your paper trail of joint activities is not extensive. The key is to understand what USCIS requires and how to present these statements effectively.

What USCIS Requires in an I-751 Affidavit

For an affidavit to be considered strong evidence, it must meet specific requirements outlined in the Form I-751 instructions. These statements are not merely character references; they are sworn declarations that USCIS officers will review carefully. Each affidavit should include the full legal name and current address of the person making the statement (the affiant). It must also list the affiant’s date and place of birth, and their relationship to you or your spouse.

Crucially, the affidavit needs to detail how and when the affiant met each of you, and how they have come to know about your marriage. This is where specific, personal observations become vital. The statement should describe concrete events the affiant has witnessed, including dates and locations. Finally, the affidavit must be signed under oath or affirmation, either by a notary public or as an unsworn declaration under penalty of perjury, as permitted by federal law.

Choosing the Right People to Write Affidavits

Selecting the right individuals to write affidavits is as important as the content of the statements themselves. USCIS prefers statements from people who have known both you and your spouse since your conditional residence was granted and have direct, personal knowledge of your marriage. A friend who has only met your spouse once or twice is not an ideal candidate.

Ideal affiants include close friends who see you regularly, neighbors who can attest to you living together, landlords or property managers who can confirm your joint tenancy, or coworkers who have met your spouse. While family members, such as parents or siblings, can write affidavits, their statements may carry less independent weight due to their personal stake in the outcome. However, if family members provide detailed, verifiable information, their statements can still be very helpful.

Understanding Affidavit Signing Methods

There are two primary ways to ensure an affidavit is properly signed: notarization or an unsworn declaration under 28 U.S.C. 1746. A notarized affidavit is signed in the presence of a notary public, who then adds their seal and signature. This is a traditional method that leaves no doubt about the authenticity of the signature.

Alternatively, an unsworn declaration under penalty of perjury can serve the same purpose. This method is recognized by federal law and allows the statement to be legally valid without a notary. The wording for this declaration differs slightly depending on whether it is signed within the United States or abroad. For statements signed outside the U.S., specific language referencing the laws of the United States is required. It is critical that the affiant understands that signing under penalty of perjury carries legal consequences for false statements.

Structuring a Strong Affidavit

A well-structured affidavit is typically one to two pages long and reads like a factual account rather than a personal endorsement. It should begin with a clear title, such as “Affidavit of [Full Name] in Support of Form I-751 for [Petitioner Name] and [Spouse Name].” Following this, the affiant should clearly state their identity, including their full name, address, date and place of birth, and occupation.

The statement should then explain the affiant’s relationship to the couple and how long they have known each spouse. The core of the affidavit will be the “Observations” section, where the affiant details three to six specific events they have witnessed, including dates, places, and what they observed. Information about the couple’s living arrangements, if known firsthand by the affiant, can also be included. Finally, the affidavit should include an offer for the affiant to be contacted by USCIS and conclude with the appropriate signature block, whether a notary jurat or a Section 1746 declaration.

I have known Michael since 2014, when we were roommates at the University of Texas. I met Priya in February 2022, when Michael brought her to my birthday dinner and introduced her as his girlfriend. Since then I have seen them together at least once or twice a month.

I attended their wedding at the Travis County Courthouse on June 3, 2023, and signed as one of their two witnesses. Afterward my wife and I hosted a small reception for them at our home.

Since the wedding, I have visited their apartment at 1180 Riverside Drive, Austin, many times. Both of their names are on the mailbox, and Priya’s work bag and Michael’s bike are always in the hallway. In November 2024 and November 2025 they hosted Thanksgiving for our group of friends; Priya cooked and Michael carved, as he does every year.

In July 2025, my wife and I traveled with them to Big Bend National Park for four days. They shared a cabin and talked with us about saving to buy a house in 2027. In March 2026 I helped them move a new couch into their apartment.

I traveled to the United States on a visitor visa and attended their wedding in Austin on June 3, 2023. I stayed with them for six weeks, from May 20 to July 1, 2023. They gave me their bedroom and slept in the living room.

From December 2024 to January 2025, Priya and Michael visited me in Pune for three weeks. Michael met our extended family at my nephew’s wedding on December 28, 2024, and stayed with Priya in my home for the entire visit.
